During the sale of a property many owners come to us to ask what to do about existing bookings and customer data specifically with regards to GDPR (2018).
1. Performance of a contract
2. Legitimate Interests
Legitimate Interest basically allows you to keep the data for any purpose of legitimate interest to running a property; this includes passing the data as part of the sale of the business. The data essentially belongs to the business, not the individual owner.
Performance of a contract allows the data to be collected in the first place.
Booking data also needs to be kept for 7 years for HMRC. Unless the customer requests it, there is no reason to separate the customer details from the booking.
There is therefore no reason to delete data unless a customer specifically asks for it. If you would like to remind yourself of the full wording of the privacy policies you can find them here.
