During the sale of a property many owners come to us to ask what to do about existing bookings and customer data specifically with regards to GDPR (2018).
All guests who have booked on the freetobook pages can click and read the Privacy Policy. The key point is that the legal bases used for holding customer data are:
1. Performance of a contract
2. Legitimate Interests
Legitimate Interest basically allows you to keep the data for any purpose of legitimate interest to running a property; this includes passing the data as part of the sale of the business. The data essentially belongs to the business, not the individual owner.
Performance of a contract allows the data to be collected in the first place.
Booking data also needs to be kept for 7 years for HMRC. Unless the customer requests it, there is no reason to separate the customer details from the booking.
